These Terms of Service (“Terms”) govern your access to and use of superhumn.co and any purchase from Superhumn, Inc. (“Superhumn,” “we,” “us”). By accessing the site or buying our products, you agree to these Terms.

1) Eligibility & Account

You must be the age of majority in your jurisdiction (or have parental consent) to use the site. You’re responsible for the accuracy of your account, orders, and keeping credentials secure.

2) Store & Products

We may change products, SKUs, pricing, promotions, or availability at any time. Colors, images, and descriptions are for reference and may vary. We may limit sales per person/household/account, consistent with applicable law.

3) Orders, Billing, Taxes & Risk of Loss

We may accept, reject, or cancel orders (e.g., suspected fraud, errors). Prices exclude applicable taxes, duties, and shipping, which you agree to pay. Title and risk of loss transfer on delivery to the carrier.

4) Shipping, Returns & Refunds

Shipping times are estimates, not guarantees. Returns and refunds are governed by our Refund Policy, which is incorporated by reference.

5) Subscriptions & Auto-Renewals (if offered)

Disclosure: If you enroll in a subscription, it renews automatically at the disclosed cadence and price until cancelled. We’ll clearly present key terms (price, frequency, how to cancel) at checkout and by email.

• Charges: You authorize recurring charges to your saved payment method until you cancel.
• Cancellation: Cancel anytime before the next renewal via your account page or by emailing hello@superhumn.co. California residents: we provide online cancellation per Cal. Bus. & Prof. Code §17600 et seq.
• Changes: We’ll notify you of material changes to renewal terms in advance as required by law.

6) User Content; Feedback; DMCA

If you submit reviews, photos, or other content (“User Content”), you grant Superhumn a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, publicly display, and distribute such content for marketing and operational purposes. You represent you own or control the rights and that your content is lawful and non-infringing.

DMCA Agent: If you believe content infringes your copyright, send a notice to legal@superhumn.co with: (a) work claimed infringed; (b) location of the material; (c) your contact info; (d) a statement under penalty of perjury; and (e) your signature. We may remove content and terminate repeat infringers.

7) Acceptable Use

Do not misuse the site (e.g., illegal activity; violate IP rights; upload malware; scrape; spam; harass; or bypass security). We may suspend or terminate access for violations, consistent with applicable law and without unlawful discrimination.

8) Food, Allergen & Health Disclaimers

Always read labels and ingredient lists before consuming. Individuals with allergies or dietary restrictions must verify suitability. Our products are not intended to diagnose, treat, cure, or prevent any disease. California Prop 65: where applicable, we provide warnings per www.P65Warnings.ca.gov.

9) SMS/Email Communications (Marketing)

By providing your number/email and opting in, you consent to receive recurring automated marketing messages from Superhumn at the contact details you provide. Consent is not a condition of purchase. Message/data rates may apply. Reply STOP to opt out, HELP for help. We maintain records of consent as required by law.

10) Privacy

Your use of the site is subject to our Privacy Policy. We honor Global Privacy Control (GPC) signals and provide a “Do Not Sell or Share My Personal Information” link in our footer.

11) Third-Party Services

We use third-party platforms (e.g., Shopify, payment processors, logistics, analytics). Their terms and privacy policies apply to their services.

12) Warranties & Disclaimers

Except as expressly stated, the site and products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow exclusions; some limits may not apply to you.

13) Limitation of Liability

To the fullest extent permitted by law, Superhumn and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; and our aggregate liability for claims arising out of or relating to these Terms or the site/products shall not exceed the greater of $100 or the amounts you paid to Superhumn for products in the 12 months preceding the claim.

14) Indemnification

You agree to defend, indemnify, and hold harmless Superhumn and its affiliates from claims, damages, costs, and fees (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your violation of law or third-party rights.

15) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., acts of God, labor disputes, shortages, war, terrorism, government action, internet or utility failures).

16) Export & Sanctions

You may not use or purchase our products in violation of U.S. export control, sanctions, or anti-corruption laws.

17) Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully—it affects your rights.

• Informal process: Before filing a claim, email legal@superhumn.co with a brief description and your contact info; we’ll try to resolve within 30 days.
• Arbitration: If not resolved, disputes between you and Superhumn will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Rules. Venue: Los Angeles County, California, unless the arbitrator permits remote proceedings. The arbitrator may award individual relief.
• Class waiver: You and Superhumn waive any right to a jury trial and to participate in class, consolidated, or representative actions. Mass arbitration: JAMS may batch materially similar claims to promote efficiency.
• Exceptions: Small-claims court actions and claims for injunctive relief to protect IP or prevent unauthorized access are not subject to arbitration.
• Opt-out: You may opt out of arbitration within 30 days of your first acceptance of these Terms by emailing legal@superhumn.co with subject “Arbitration Opt-Out.”

18) Governing Law & Venue

These Terms are governed by the laws of the State of California (without regard to conflicts of law). Subject to Section 17, the exclusive venue for any non-arbitrable action is the state or federal courts in Los Angeles County, California, and you consent to personal jurisdiction there.

19) Changes to the Terms

We may update these Terms by posting a new date. Material changes will be noted on this page. Your continued use after changes means you accept the updated Terms.

20) Miscellaneous

• Severability: If any provision is unenforceable, the rest remain in effect.
• No waiver: Failure to enforce is not a waiver.
• Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or successor.
